Legal Terms & Liability Disclaimer – DAT Tranquilitea Spot & DAT Snapped Spot. By booking services with DAT Tranquilitea Spot (bubble tea) and/or DAT Snapped Spot (photo booth/360 booth), the client agrees to the following terms and conditions, which are legally binding upon confirmation of booking:

1. Assumption of Risk & Release of Liability:

The client acknowledges and accepts that: Boba tea may pose a choking hazard, particularly to children under 5 or individuals who consume beverages too quickly. All beverages are clearly labeled and served with appropriate warnings. Consumption is at the guest's own risk. Some beverages and toppings may contain allergens (including but not limited to dairy, nuts, fruit, and other common allergens). It is the responsibility of the client and their guests to disclose any food allergies. While reasonable care is taken to avoid cross-contamination, DAT Tranquilitea Spot assumes no liability for allergic reactions. The photo booths (including enclosed and 360 booths) are designed for safe, normal use only. While safety measures are in place, any horseplay, reckless behavior, misuse of equipment, or failure to follow staff instructions may result in injury or equipment damage. DAT Snapped Spot is not liable for injury caused by improper use of the booth or related equipment. The client assumes full responsibility for ensuring that all guests use the photo booth equipment safely and appropriately.

2. Insurance:

DAT Tranquilitea Spot and DAT Snapped Spot are fully insured for general liability. However, the booking entity (client) assumes all risk and responsibility for the behavior and safety of guests during the use of all services provided. Proof of insurance may be provided upon request.

3. Booking & Cancellation Contract Terms:

A booking is considered confirmed and contractually binding once a non-refundable deposit is received, unless otherwise documented and agreed to in writing by both parties. No changes to the service date, time, or scope will be honored unless mutually agreed upon and confirmed in writing. Deposits are non-refundable, unless the business owner is unable to fulfill the agreement due to an emergency or cancellation on behalf of the business. In the event of client-requested changes or cancellations, no deposit refund will be issued unless otherwise agreed to in writing. If booking is cancelled 14 days or less before the event a cancellation fee minimum of $25 maximum of $100 maybe charged

4. Event Timing & Overage Fees:

If the event begins later than the agreed start time, or the client requests additional time during the event, an overtime fee of $100 per additional hour will apply. Overage time must be paid in full at the time of service upon verbal or in written agreement during the event. Time extension is at owners discretion.

5. Damage Responsibility:

The client is financially responsible for any damage, theft, or excessive cleaning required as a result of misuse or negligence by guests. This includes damage to:Photo booth equipment (enclosed or 360 booth). Props, décor, or other event equipmentBoba tea service equipment (dispensers, coolers, signs, etc.)

6. MARKETING

Use of Photos/Videos for Marketing unless otherwise requested in writing, DAT Snapped Spot reserves the right to use event photos and videos for marketing and promotional purposes, including use on social media, websites, and advertising. Unless otherwise declined in writing by client.

7. Force Majeure:

DAT Tranquilitea Spot and DAT Snapped Spot are not responsible for delays or cancellations caused by events beyond their control, including but not limited to natural disasters, extreme weather, illness, venue issues, or unforeseen emergencies. In such cases, all reasonable efforts will be made to reschedule or provide a refund at the owner's discretion. Owners inability to perform contractual agreements for any other reason will result in a full refund. If issue arises during event refund will be pro-rated.

8. Acceptance of Terms:

By submitting a deposit or final payment, the client confirms that they have read, understood, and agreed to all terms outlined in this agreement.
